Wemingle Terms and Conditions of Use

General Conditions

• We reserve the right to modify or terminate the Wemingle service for any reason, without notice at any time.
• Wemingle reserves the right to modify or amend this agreement at any time and for any reason. The most recent version of this agreement will be posted on the Wemingle website. If the alterations constitute a material change to the Terms and Conditions of Use, we will notify all registered users by the electronic mail address associated with their account.
• We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

Member Conduct

Use of the services by you, as a member, is subject to all applicable local, provincial, state, national and international laws and regulations. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time. We may, but have no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms and Conditions of Use.

• You must not abuse, harass, threaten, impersonate or intimidate other Wemingle users.
• You shall not list as referrals any email addresses that are fake, fictitious, or made up.
• You shall not list as referrals any email addresses which are owned by or belong to you.
• You will not send or otherwise post unauthorized commercial communications to other users.
• You will not upload viruses or other malicious code.
• You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
• You shall not provide material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under the age of 18.
• You shall not provide instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• You must not modify or hack any Wemingle service or modify another website so as to falsely imply that it is an associated Wemingle service.

Violation of any of these agreements will result in the full termination of your Wemingle account and to all current and future Wemingle services. A user is not necessarily offered a warning. An account may be terminated at any time, without notice, depending on the severity of the offense.

Privacy

Wemingle has established a Privacy Policy; we have developed this policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. We encourage you to read the Privacy Policy, so you may make informed decisions when posting personal material with any associated Wemingle service.

Registration and Account Security

• You will not use any Wemingle social service if you are under the age of 13.
• You will not provide Wemingle with false information, or register an account for anyone other than yourself.
• You will keep your contact information current and up to date.
• You are responsible for keeping your password secure.
• You are responsible for any activity that occurs under your account, be it you or otherwise.

Copyrights, Trademarks, Patents and Intellectual Property Rights

• We claim no intellectual property rights over the material you provide to any Wemingle service. You retain all rights to any material you personally loaded into any Wemingle service. You can remove your profile at any time by disabling your account, removing information from your account, or restricting your profile using available privacy settings.
• Illegal or unauthorized copying, distribution, modification, public display, or public performance of copyrighted works is an infringement of the copyright holders' rights. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Wemingle through our Contact Us page.

  • Identify the copyrighted work or other intellectual property that you claim has been infringed;
  • Identify the material on Wemingle that you claim is infringing, with enough detail so that our agent may locate it;
  • A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
  • Your contact information, including your address, telephone number, and email;
  • A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner.

Disclaimers of Warranties

You agree that use of any Wemingle service is entirely at the users own risk. The materials on Wemingle's web sites and services are provided "as is". Wemingle makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Wemingle does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web sites and services or otherwise relating to such materials or on any sites linked to this site.

Limitation of Liability

In no event shall Wemingle or its suppliers be liable for any damages on account of and member's use or misuse of any Wemingle service, nor for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Wemingle's Internet sites and services, even if Wemingle or a Wemingle authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Governing Law

Any claim relating to Wemingle's web site or services shall be governed by the laws of the Province of Ontario without regard to its conflict of law provisions.
